What is Permanent Residence Visa for Australia?

Permanent Residence is a right affixed into your passport granting you the permanent right to live and work in the Australia. You are eligible for state medical care immediately, but must be resident in Australia for two year‘s before qualifying for social welfare assistance (i.e. unemployment benefits).

You are not permitted to vote as a permanent resident in Australia. After two years, you can apply for citizenship, entitling you to an Australian passport. Temporary residents (those on student and work visas) are generally not entitled to medical care or social welfare assistance at any time and are generally unable to remain for longer than 4 years. These applicants are recommended to take out private health insurance.

Permanent Residence means you are allowed to live in Australia indefinitely, with unlimited right to work, engage in business, own property, study and do most of the things a citizen can do. There are some restrictions on access to social security, particularly in the first two years. Permanent residence can be lost by spending too long outside the country.

Under Permanent Residence visa to Australia how many people are granted the right to live each year?

The planning level for the migration (non-humanitarian) programme for 2009/10 is set at 168,700 places. Under Permanent Residence visa the numbers can keep changing every year.

How can I become a permanent resident holder of Australia?

The only way you can become a permanent resident of Australia is to be granted a permanent visa by the Australian government, either inside or outside the country. For full details of the requirements for the many different categories of permanent visas, see our immigration page.

How can I find I am eligible to become a permanent resident of Australia?

If you are interested in migrating to Australia, please fill out the Free Assessment which is found in our website and we will assess if you will qualify under the Permanent Residence visa. We work with members who are members of Migration Institute of Australia (MIA) and Migration Agents Registration Authority (MARA) Representative and strive to achieve the highest possible standards of professional service.

We will assess your eligibility and come back to you at the earliest to advise you how to proceed further.

What are the current qualifying pass mark for the different visa classes?

There are different types of subclasses that one can qualify. Currently for PR visa the pass mark is 120 points and also there is a pool mark that is set by the Immigration department. If you would like to know if you meet these pass mark, we will assess your data and advise you. Please go ahead in filling up our Assessment Form to advise you.

How much time will I be given to move to Australia once I obtain my approval letter?

Once the Permanent Residence visa is approved, you must be within one year from the date of your medical tests or police certificates, which occur during the processing of your Australian residence visa application. If you deduct part of the official processing time, you will generally be left with 8 to 12 months to land in Australia. The exception is for temporary visas, such as work visas, in which case you may only have a number of months to enter the country.

The initial entry date (stated on your visa) is the date by which you must travel to Australia on your visa. This date is calculated based on the validity of your health and character clearances. These clearances are usually only valid for 12 months. If you (and any members of your family included in your application) do not enter Australia by the initial entry date, you will breached a condition of your visa and consideration will be given to canceling your visa.

Will a good sportsman qualify to apply for a visa ?

If you have a Distinguished Talent and you have an exceptional or outstanding record of achievement in the arts or sport you may apply under this sub class. You must be nominated by an Australian citizen, an Australian permanent resident, an eligible New Zealand citizen or an Australian organisation of national reputation in the occupation, profession, or activity in which you have an outstanding talent.

Your nominator should complete an application form and include a brief resume of their own standing in the field.

What can I expect your company to advise me after my data is assessed ?

An approved MARA agent will personally assess your eligibility for immigration to Australia and, if it is determined that you may qualify for immigration you will receive a detailed response together with a quotation for the fees. This response takes the form of a thorough assessment, and includes details of any other requirements that you will have to satisfy, such as English language, health or character checks.

Due to the very large numbers of people looking for immigration solutions around the world, it is only possible for responses to be sent to people whom our office will assess as potentially qualified for migration to Australia. People who are assessed as not qualified will also receive a response.

Please note that all information is kept in the strictest confidence and, for your protection, is not stored on any of our servers.

If you have been positively assessed, it is because our MARA agent believes that stand a very good chance of being approved for migration to Australia with their assistance.

The firm works hard on successful immigration cases and referrals from satisfied clients and, to further back this up, we only lodge applications that will succeed with the Immigration department and prior to lodgment we will assess your data, have your skills assessment completed and all other requirements before we lodge. The details of this offer will be given as part of the assessment. Please visit our website on the step-by-step procedure.

Do I need to have my qualifications assessment done before applying for Residence visa?

For all Skilled Migration applications it is necessary to obtain the Skills assessment by a "relevant assessing authority" before we can lodge your visa application.

We will need to obtain the Skills assessment report from the respective assessment body towards preparation of your application for lodgment. Bilimoria & Associate will assist with the preparation of applications for assessment and will advise you of the requirements for Skills assessment.

Where do I submit my application once all documents are ready for lodgment?

The Australian government has been implementing a practice of removing visa processing from Australian Embassies around the world and concentrating it in special offices set up in regional cities in Australia.

All skilled migration is now handled by an office in Adelaide, while business migration applications are processed in Perth. Our MARA agent will prepare your application for on-line lodgment and we believe in lodging a fully-loaded application for a successful outcome.

How long does the Immigration application process take?

Time is something we can't advise till we decide on what subclass an application is lodged . A large number of variables are involved, including "capping" of the number of visas in a given category to meet annual quotas set by the Australian government.

All we can promise to do is to minimise delays by ensuring that the correct documents and information are provided to the authorities on time.

Will I have to attend an interview?

Most of our applications are lodged as advised with all supporting documents, filled in application forms and meet all the other supporting information such as completion of IELTS, Police Clearance and are lodged on-line and as such if all documents are in order the client doesn’t need to attend an interview. We believe in lodging an application that could be approved by the visa officer provided we have all documents as per their request to avoid personal interview.

Interviews are common for business migration applications and are usually conducted by telephone. Some spouse and other family visa applicants may be called for interview at an Australian Embassy overseas.

Why do I need the services of a Consultant / Lawyer / MARA agent to lodge my application to migrate to Australia?

You can apply for migration visa to Australia on your own. There is absolutely no legal requirement that you get help from a Consultant / Lawyer / MARA agent or anyone else. You can also lodge your tax declaration without help, do your accounts without help, represent yourself in Court, and do lots of other things on your own without getting help from a professional. In some countries, things have to be done through facilitators to make the process smooth and be sure on the success of an application.

The immigration law is extremely complex and changes frequently. In some instances, failure to provide the correct documents within a given timeframe can result in an application be refused which would otherwise have been successful.

Also, if your application cannot be approved under one category an experienced Consultant / Lawyer / MARA agent may be able to direct you towards another possibility or suggest on how good your chances can be on the required subclass towards lodging your application. Bilimoria & Associate assists you to provide exactly the information expected by the Australian authorities and ensure that the application forms are correctly filled out.

They draft the written legal submissions which accompany the application package and draw the authorities' attention to the relevant law and policies on which your case is based on the information provided by you by our approved MARA agent. We will also advise you of the procedures involved in satisfying other requirements such as health and police clearances, English language tests, etc. Where telephone interviews are required, as is the case with most business migration applications.

Why do most people use an officially-recognised migration agent to double-check their visa application?

Mostly to protect themselves from the HIGH FAILURE RATE: Permanent Residence visa applicants fail to receive their residence visas due to application errors, misunderstandings or confusion that commonly arise during the immigration process. This compares to an average success rate of over 100% for those applicants that lodge their applications through an officially-recognised migration agent.

Bilimoria & Associate liaises with a company which is one of the oldest migration agencies in Australia and has 5 Registered Agents plus support staff towards preparation of a successful application. The Principal is a Registered MARA agent and he has many years of experience, including 16 years with the Australian Government. The agents are all members of the Migration Institute of Australia and strive to achieve the highest possible standards of professional service. Bilimoria & Associate liaise with Migration Agents Registration Authority (MARA) and Member of Migration Institute of Australia (MIA).
